KBF Event Participation Terms and Conditions

Event Participation Conditions

By registering for any Kayak Bass Fishing Competition Event, Competitor agrees to fully and completely comply with all KBF Rules (comprised of both the KBF Competition Rules Standards and KBF Competition Rules Addenda) and the terms and conditions specified herein. Failure to comply with KBF’s Rules is grounds for immediate dismissal from the Event. Persons dismissed from the Event shall not be entitled to a refund or cancel any unpaid balance due.

These terms and conditions apply between Kayak Bass Fishing, LLC (“KBF”) and those persons registering for and participating in KBF competitive events (“Competitor”).

“Events” include both “Tournaments” (meet-up competition) and “Challenges” (distributed competition where participants do not congregate).

The pronouns “he,” “him,” “himself,” and “his” herein are used as generic, gender-neutral terms and do not restrict or confirm access on the basis of sex.

Event Registration and Acceptance of Competitor

Registration is on a first-come, first-served basis. Early registration helps to ensure availability. Walk-in registrations will be accepted on a space-available basis.

By registering for this Event, Competitor represents, warrants and ensures that he is physically and mentally able to participate in the activity for which he is registering and/or any others in which Competitor may participate.

Competitor understands that this registration is non-transferrable and non-assignable and that any other person wishing to participate in the event must register in his own name(s).

KBF reserves the right to substitute, at any time, speakers, presenters, facilities, venue and/or any aspect of the Event program.

Competitors who have any questions concerning the Event should contact KBF directly.

KBF reserves the right to refuse participation in its Events to any individual.

Competitor’s failure or inability, for any reason except as otherwise provided herein, to participate in any or all of the activities of the Event does not relieve or suspend the Competitor’s obligation to make all payments required hereunder on a timely basis, nor entitle the Customer to a refund or credit.

Competitor understands and agrees that payment for the Event does not secure a guarantee or promise of satisfaction.

Competitor agrees that once an Event Registration is submitted, this Agreement is a legally binding and enforceable obligation of Competitor.

KBF Event Entry Fee payments are processed using PayPal, unless otherwise stated in the KBF Event Description Web Page or Documentation. Competitor (or Third Party who is paying on behalf of the Competitor) knowingly and irrevocably authorizes KBF to charge electronically Competitor‘s (or Third Party Payer’s) PayPal account, bank account and/or credit card for any and all amounts due for Competitor’s registration, attendance, and participation in the KBF Event.

Competitor’s Right to Cancel

Any competitor who wishes to cancel an Event Registration may do so by emailing KBF (accounting@kayakbassfishing.com).
For Tournaments, if cancellation email is dated more than 15 days prior to the Event, no administrative fee will be charged. Any cancellation dated 15 days or fewer before the Event shall result in a per person administrative fee equal to the lesser of $25 or 30% of the Event Registration Fee.

For Challenges, if cancellation email is dated more than 1 day prior to the Event, no administrative fee will be charged. Any cancellation dated 1 day or less before the Event shall result in a per person administrative fee equal to 30% of the Event Registration Fee.

Once an Event has started, no cancellations will be accepted and no refunds will be provided.

KBF is not responsible for any refunds of expenses related to travel or lodging reservations or other payments involving third parties.

Release and Indemnification

Competitor understands and agrees that his participation in and attendance at the Event is knowing and voluntary. Competitor understands and agrees that strict observation of the Event rules and regulations is required and that use of the Event facilities and the Competitor’s presence at the Event are at the sole risk of the Competitor. Competitor indemnifies and holds harmless KBF and its officers, directors, employees and agents from and against any claims, demands, actions, liabilities, damages, costs or expenses, including court costs and reasonable attorneys’ fees arising out of or relating to: (i) Competitor’s participation in the Event; (ii) claims against KBF by any third parties arising from or related to KBF’s actions and/or omissions, (iii) claims relating to any violation or alleged violation by KBF and/or any third party of the applicable laws relating to the conduct of the Event; and/or (iv) claims arising from or relating to KBF’s performance of its obligations hereunder. Competitor specifically understands and agrees that he is assuming the risk of any and all injuries that he may suffer or incur as a result of his registration and/or participation in the Event. Competitor’s indemnification obligations shall survive the expiration or termination of this agreement.
